§ 16 BlnDSG

Responsibility in the Transmission of Personal Data

(1)Where the transmission is effected at the request of a public body, that body shall bear responsibility for the lawfulness of the transmission. The transmitting body shall merely examine whether the request for transmission falls within the scope of the requesting body's tasks. It shall examine the lawfulness of the request only where there is specific reason to do so in the individual case. The requesting body shall provide in its request the information necessary for this examination.
(2)Where the transmission is effected by an automated retrieval procedure pursuant to Section 21, the retrieving body shall bear responsibility for the lawfulness of the transmission. The transmitting body shall examine the lawfulness of retrievals only where there is reason to do so. The transmitting body shall ensure that the transmission of personal data can at least be ascertained and reviewed by means of suitable sampling procedures. zur Einzelansicht § 16 Kapitel 2 Besondere Verarbeitungssituationen
