Duty of Confidentiality
(1)The Hessian Data Protection Commissioner shall be obliged, even after the end of his or her official relationship, to maintain confidentiality regarding the matters that have come to his or her knowledge in the course of official activities. This shall not apply to communications in official dealings or regarding facts that are common knowledge or that, by their nature, do not require confidentiality. Sentences 1 and 2 shall apply accordingly to his or her employees. The Hessian Data Protection Commissioner shall be deemed to be the supreme official authority within the meaning of § 96 of the Code of Criminal Procedure. He or she shall decide in accordance with the provisions on the obligation of authorities to submit documents and provide information in the procedural codes of the courts. The Hessian Data Protection Commissioner shall take the decisions pursuant to § 37 para. 3 of the Civil Servants' Status Act and § 46 of the Hessian Civil Service Act for himself or herself and for the civil servants employed by him or her. zur Einzelansicht § 12
