§ 40 HDSIG
Scope of Application
(1)The provisions of this Part shall apply to the processing of personal data by public bodies competent for the prevention, investigation, detection, prosecution or punishment of criminal offences or administrative offences, including the protection against and the prevention of threats to public security. This shall apply insofar as the public bodies process personal data for the purpose of fulfilling these tasks. The public bodies shall be considered controllers in this regard.
(2)Para. 1 shall also apply to those public bodies which are competent for the enforcement and execution of penalties, of measures within the meaning of § 11 para. 1 no. 8 of the Criminal Code, of educational measures or disciplinary measures within the meaning of the Youth Courts Act, and of fines.
