Video Surveillance of Publicly Accessible Spaces
(1)The observation of publicly accessible spaces with opto-electronic devices (video surveillance) shall only be permissible insofar as it 1. is necessary for the performance of tasks of public bodies, 2. is necessary for exercising the right of domiciliary authority and there are no indications that the legitimate interests of the data subjects prevail.
(2)The fact of the observation as well as the name and contact details of the controller shall be made recognisable by appropriate measures at the earliest possible time.
(3)The storage or use of data collected pursuant to para. 1 shall be permissible where it is necessary to achieve the pursued purpose and there are no indications that the legitimate interests of the data subjects prevail. Processing for another purpose shall only be permissible insofar as it is necessary for averting dangers to state and public security and for the prosecution of criminal offences and non-minor administrative offences.
