§ 56 HDSIG

Legal Remedy Against Decisions of

(1)the Hessian Data Protection Commissioner or in the Event of Inaction
(2)Every natural or legal person may, without prejudice to other legal remedies, take legal action against a binding decision of the Hessian Data Protection Commissioner concerning him or her.
(3)Para. 1 shall apply accordingly in favour of data subjects where the Hessian Data Protection Commissioner has not dealt with a complaint pursuant to § 55 or has not informed the data subject of the progress or outcome of the complaint within three months of lodging the complaint.
