§ 36 HDSIG
Application of the Provisions on Administrative Fine and Criminal Proceedings for
(1)Infringements under Article 83 of Regulation (EU) No 2016/679
(2)For infringements under Art. 83 para. 4 to 6 of Regulation (EU) No 2016/679, unless otherwise provided by this Act, § 41 para. 1 sentence 1 and 2 and para. 2 of the Bundesdatenschutzgesetz shall apply mutatis mutandis.
(3)No administrative fines shall be imposed against authorities and other public bodies pursuant to § 2 para. 1 sentence 1 for infringements under Art. 83 para. 4 to 6 of Regulation (EU) No 2016/679.
(4)A notification pursuant to Art. 33 of Regulation (EU) No 2016/679 or a notification pursuant to Art. 34 para. 1 of Regulation (EU) No 2016/679 may only be used in proceedings under the Act on Administrative Offences against the person obliged to notify or his or her relatives designated in § 52 para. 1 of the Code of Criminal Procedure with the consent of the person obliged to notify.
