§ 55 HDSIG

Calling Upon the Hessian

(1)Data Protection Commissioner
(2)Every data subject may, without prejudice to other legal remedies, lodge a complaint with the Hessian Data Protection Commissioner if he or she is of the opinion that the processing of his or her personal data by public bodies for the purposes referred to in § 40 violates his or her rights. This shall not apply to the processing of personal data by courts insofar as the courts have processed the data in the exercise of their judicial function. The Hessian Data Protection Commissioner shall inform the data subject of the progress and outcome of the complaint and shall advise him or her of the possibility of judicial remedy pursuant to § 56.
(3)Where the Hessian Data Protection Commissioner receives a complaint concerning processing that falls within the competence of another supervisory authority, he or she shall forward it to that authority without undue delay.
