Rectification and Erasure of Personal Data
(1)and Restriction of Processing
(2)The controller shall rectify personal data where they are inaccurate. § 53 para. 1 sentences 2 and 3 shall apply accordingly.
(3)The controller shall erase personal data without undue delay where their processing is unlawful, where their knowledge is no longer necessary for the performance of his or her tasks, or where they must be erased in order to comply with a legal obligation.
(4)§ 53 para. 3 to 5 shall apply accordingly. Where inaccurate personal data or personal data have been unlawfully transferred, the recipient shall also be notified thereof.
(5)Without prejudice to maximum storage or erasure periods laid down in legal provisions, the controller shall provide for appropriate periods for the erasure of personal data or for a regular review of the necessity of their storage and shall ensure through procedural safeguards that those periods are observed. zur Einzelansicht § 70
