§ 81 HDSIG
Scope of Application
(1)In accordance with § 2 para. 1 to 3, the provisions on information access shall also apply to 1. the Landtag, only insofar as it performs public-law administrative tasks and it can be ruled out that the freedom of the mandate, the area of members' and parliamentary groups' affairs, and the non-public nature of Landtag deliberations are impaired by the granting of information access, 2. the Hessian Court of Audit, the Supra-local Audit of Municipal Bodies in Hessen and the Land Commissioner for Economy in the Administration, insofar as they perform administrative tasks not connected with their auditing and control activities, 3. the Hessian Data Protection Commissioner, insofar as he or she performs general administrative tasks, 4. the courts, law enforcement and criminal enforcement authorities and other bodies referred to in § 40 para. 2, but only insofar as they perform public-law administrative tasks and not insofar as they act in the exercise of their judicial function, 5. tax authorities, only insofar as they do not act in proceedings under the Fiscal Code, 6. university hospitals, research institutions, universities, schools and other public bodies, insofar as they do not operate in the areas of research and teaching, performance assessment and examinations, 7. the authorities and other public bodies of the municipalities and counties as well as their associations regardless of their legal form, insofar as the application of the Fourth Part is expressly determined by charter, 8. the Hessischer Rundfunk, insofar as it performs tasks of public administration, and the Hessian State Authority for Private Broadcasting and New Media, insofar as it does not operate in the areas of licensing and supervision.
(2)The provisions of the Fourth Part shall not apply to 1. the police authorities and the Land Office for the Protection of the Constitution, 2. the Land cartel authority and the Regulatory Chamber of Hessen, 3. the chambers of industry and commerce and the chambers of crafts, 4. notaries, 5. the disciplinary bodies in the exercise of their disciplinary functions.
(3)Insofar as information access is excluded under para. 1 or 2, this shall also apply to file and record components contained in the files or records of other public bodies. zur Einzelansicht § 81
