§ 19 HDSIG
Judicial Remedy
(1)Administrative courts shall have jurisdiction over disputes between a natural or legal person and the Hessian Data Protection Commissioner concerning rights under Art. 78 para. 1 and 2 of Regulation (EU) No 2016/679 and § 56. Sentence 1 shall not apply to proceedings concerning administrative fines.
(2)§ 20 para. 2, 3, 5 and 7 of the Bundesdatenschutzgesetz shall apply mutatis mutandis to proceedings under para. 1 sentence 1.
(3)The Hessian Data Protection Commissioner shall have the capacity to be a party in proceedings under para. 1 sentence 1.
(4)§ 44 of the Bundesdatenschutzgesetz shall apply mutatis mutandis to actions brought by data subjects against a controller or processor for a violation of data protection provisions within the scope of application of Regulation (EU) No 2016/679 or of the rights of the data subject contained therein.
(5)Authorities and other public bodies of the Land may, without prejudice to other legal remedies, take legal action against binding decisions of the Hessian Data Protection Commissioner concerning them. If the authority or public body does not comply with a binding decision of the Hessian Data Protection Commissioner and does not take legal action against it within one month of notification, the Hessian Data Protection Commissioner may apply for a judicial finding of the lawfulness of the binding decision.
