§ 89 HDSIG
The Hessian Freedom of Information Commissioner
(1)Anyone who considers their right under the Fourth Part to have been violated may, without prejudice to other legal remedies, appeal to the Hessian Freedom of Information Commissioner.
(2)The task of the Hessian Freedom of Information Commissioner shall be performed by the Hessian Data Protection Commissioner.
(3)The bodies subject to the obligation to provide information shall support the Hessian Freedom of Information Commissioner and his or her representatives in the fulfilment of their tasks. In particular, the Hessian Freedom of Information Commissioner shall be granted 1. information regarding the matter in respect of which he or she was called upon and access to the relevant files and databases, and 2. access to official premises. Where the Hessian Freedom of Information Commissioner identifies violations of the provisions of the Fourth Part, he or she may request their rectification within a reasonable period. The competent supervisory authority shall be informed thereof.
(4)By 31 December of each year, the Hessian Freedom of Information Commissioner shall submit a report on his or her activities to the Landtag and the Land government.
