§ 5 HDSIG
Designation
(1)Public bodies shall designate a data protection officer and his or her deputy.
(2)Taking into account the organisational structure and the size of several public bodies, a joint data protection officer may be designated.
(3)The data protection officer shall be designated on the basis of his or her professional qualities and, in particular, expert knowledge of data protection law and data protection practice, as well as the ability to fulfil the tasks referred to in § 7.
(4)The data protection officer may be an employee of the public body or may fulfil his or her tasks on the basis of a service contract.
(5)The public body shall publish the contact details of the data protection officer and communicate these to the Hessian Data Protection Commissioner. zur Einzelansicht § 5
