§ 77 HDSIG
Mutual Assistance
(1)The Hessian Data Protection Commissioner shall transmit information to and provide mutual assistance to the data protection supervisory authorities in other Member States of the European Union, insofar as this is necessary for a consistent implementation and application of Directive (EU) No 2016/680. The mutual assistance shall relate in particular to requests for information and supervisory measures, such as requests for consultation or for the conduct of inspections and investigations.
(2)The Hessian Data Protection Commissioner shall take all appropriate measures to respond to requests for mutual assistance without undue delay and no later than one month after their receipt.
(3)The Hessian Data Protection Commissioner may only refuse a request for mutual assistance where 1. he or she is not competent for the subject matter of the request or for the measures which he or she is to carry out, or 2. compliance with the request would violate legal provisions.
(4)The Hessian Data Protection Commissioner shall inform the requesting supervisory authority of the other state about the results or, where applicable, about the progress of the measures taken to comply with the request for mutual assistance. He or she shall explain the reasons for refusing the request in the case of para. 3.
(5)The Hessian Data Protection Commissioner shall, as a rule, transmit the information requested by the supervisory authority of the other state electronically and in a standardised format.
(6)The Hessian Data Protection Commissioner shall handle requests for mutual assistance free of charge, unless he or she has agreed with the supervisory authority of the other state in the individual case on the reimbursement of expenses incurred.
(7)A request for mutual assistance by the Hessian Data Protection Commissioner shall contain all necessary information; this shall include in particular the purpose and the reasons for the request.
